Terms of Service for Manai

Service Description
Manai provides a personalized AI-powered audio experience, allowing users to generate guided visualization audios tailored to their desires. The app generates scripts and artwork for free users. Paid subscribers get access to AI-voice narration of the scripts. A recorder is provided for self-recorded scripts.
Manai is not a substitute for professional counseling, therapy, medical treatment, or any form of mental health care. The Service is designed for personal development and entertainment purposes only. If you are experiencing distress, mental health concerns, or medical issues, we strongly encourage you to seek support from a qualified professional. Manai does not provide medical or psychological advice, diagnoses, or treatments.
1. Acceptable Use Policy
Users must not misuse the Service or assist others in doing so. Prohibited activities include, but are not limited to:
- Attempting to reverse-engineer, scrape, or otherwise extract data from the platform without authorization.
- Using automated scripts or bulk-generated accounts to access or manipulate the Service.
- Engaging in any activity that disrupts the normal operation of the platform or degrades user experience.
- Attempting to bypass security measures, access unauthorized data, or compromise system integrity.
- Uploading copyrighted materials that the user does not have the rights to use.
Free users do not have access to generate AI voice content but may generate scripts and artwork. No warranties are made for free users.
2. Content Policy
Users must ensure that all generated and uploaded content complies with ethical and legal standards. The following content is strictly prohibited:
- Harmful & Dangerous Content: Any material that promotes or incites violence, self-harm, abuse, or harm toward individuals or groups.
- Hate Speech & Discrimination: Content that targets individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected attributes.
- Sexually Explicit Content: Pornographic, sexually suggestive, or non-consensual intimate imagery.
- Illegal & Unlawful Content: Any content that promotes or facilitates illegal activities, including but not limited to fraud, drug trafficking, human exploitation, or unauthorized hacking.
- Misinformation & Manipulation: Spreading false or misleading information, deepfakes, or deceptive content intended to manipulate public opinion or deceive others.
- Exploitive & Defamatory Content: Material that harasses, defames, or exploits individuals, including minors.
Manai actively moderates generated content. Any attempt to generate restricted content will likely fail due to content filtering and may result in unpredictable responses. Violations may lead to content removal, warnings, or account suspension.
3. Intellectual Property
The Service and all original content, features, and functionality remain the exclusive property of Manai. Background audios are licensed, and rights holders may request proof of purchase if needed.
4. User-Generated Content
- User-generated audios remain private and accessible only to the user, with limited exceptions.
- We may review audios in specific cases: (1) for compliance with our Terms of Service, (2) to investigate reported issues, or (3) to ensure the proper functioning of our services.
- We may request explicit consent to use anonymized portions of audios for service improvement.
- We will never use user-generated audios for marketing without explicit, opt-in consent.
- Generated scripts may be processed by AI to enhance user experience, such as improving prompts.
- Recorded audios are stored securely in the cloud to ensure accessibility and device storage efficiency. Users retain full ownership of their likeness and recordings. Manai will never use or distribute user recordings without explicit, written consent. While users own their recordings, they are not entitled to export them outside of the app. Audios can be accessed within the app as is or deleted at the user's discretion.
- Users may permanently delete their audios via the Library tab. Deleting an account results in the automatic deletion of all associated audios.
5. AI & Machine Learning Disclaimer
Manai utilizes AI to generate visualization scripts and associated content. While we strive to ensure high-quality experiences, AI-generated content may not always be accurate, appropriate, or aligned with user expectations.
Manai is not responsible for any inappropriate, offensive, or harmful content that may be generated. Users attempting to create violent, hateful, or otherwise restricted content may receive unpredictable responses due to content moderation systems.
6. Third-Party Services & Integrations
The Service relies on third-party providers, including:
- AWS for infrastructure hosting.
- Sentry for application observability and monitoring.
- RevenueCat and the App Stores (Apple & Google) for payment processing.
We explicitly disclaim liability for failures, outages, or limitations caused by these third-party providers.
By using Manai, users also agree to the Terms of Service and Privacy Policies of these third-party providers if applicable. It is the user's responsibility to locate the latest versions of these documents.
7. Updates to Terms
These Terms may be updated periodically. Users will be notified of significant changes, and the "Last Updated" date will be revised accordingly. We will make a best effort to summarize material changes, but users are ultimately responsible for reviewing and accepting the full updated Terms of Service.
If we make material changes, you will be required to accept the updated terms to continue using our services. If you do not accept the updated terms, you will no longer be able to access the Service, and it is your responsibility to cancel your subscription to avoid further charges. Continued payments without acceptance of the new terms will not constitute a refund-eligible claim.
8. Indemnification
Users agree to indemnify and hold Manai, its affiliates, officers, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from:
- Their use of the Service, including but not limited to the creation, sharing, or distribution of AI-generated content.
- Any violation of these Terms.
- Any harm or damage caused by AI-generated content, including but not limited to inaccuracies, offensive material, or unintended interpretations.
Users acknowledge and accept that AI-generated content is inherently unpredictable. If any content is deemed inappropriate, offensive, or harmful, users should report it to support@manai.app.
9. Limitation of Liability
Manai shall not be liable for indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use the Service.
10. Force Majeure
Manai shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to:
- Server failures, cyberattacks, or AI processing outages.
- Changes in legal regulations affecting AI-based services.
- Natural disasters, power outages, or other unforeseen events.
In the event of prolonged service disruption due to force majeure events, users remain responsible for their subscription payments unless otherwise stated.
11. Governing Law
These Terms are governed by and interpreted in accordance with the laws of Norway, except where mandatory consumer protection laws in the user's home country provide otherwise. In such cases, applicable local laws may take precedence over specific provisions of these Terms to the extent required by law.
Furthermore, the terms and conditions outlined in this agreement are subject to the policies and regulations of the respective app stores where Manai is available, including but not limited to the Apple App Store and Google Play Store. If there is a conflict between these Terms of Service and an app store's policies, the app store's policies shall take precedence with respect to billing, refunds, and subscription management. Users are responsible for understanding their rights under applicable consumer protection laws and the policies of their chosen app store.
